Article 2 – Purpose and scope

These General Terms and Conditions of Sale govern product sales made through the IEL Cosmetique website between the seller and any customer acting as a consumer.

Confirming an order constitutes full and unconditional acceptance of these General Terms and Conditions of Sale.

Article 3 – Products

The products offered for sale are those displayed on the website, subject to availability.

The essential characteristics of each product are stated on its product page. Photographs are illustrative and slight differences in colour or appearance may occur depending on the screen used.

Article 4 – Prices

Prices are stated in euros. VAT is not applicable pursuant to Article 293 B of the French General Tax Code.

IEL Cosmetique may change its prices at any time. Products are invoiced at the price displayed when the order is confirmed, except in the event of an obvious display error.

Delivery charges are shown before final confirmation of the order.

Article 5 – Orders

The customer selects the products, checks the shopping basket, provides the requested information and confirms the order after reading these General Terms and Conditions of Sale.

An order confirmation email is sent to the customer.

IEL Cosmetique may refuse or cancel an order in cases of suspected fraud, failed payment, clearly incorrect information or a previous unresolved dispute.

Article 6 – Payment

Payment is due when the order is placed and is made using the secure payment solutions offered on the website.

The order is considered finally accepted only after payment has been confirmed by the relevant payment provider.

IEL Cosmetique does not have access to the customer’s confidential bank details.

Article 7 – Delivery

Products are delivered to the address provided by the customer when placing the order. The customer must ensure that the address is accurate and complete.

Available delivery methods, charges and estimated times are shown before the order is confirmed. The seller remains responsible for proper delivery performance when the carrier was offered by the seller.

In the event of delay, loss, damage or disputed delivery, the customer should promptly contact IEL Cosmetique so that an appropriate solution can be sought.

Article 8 – Right of withdrawal

The customer has fourteen days from receipt of the goods to notify the seller of the decision to withdraw, without giving any reason.

After notifying withdrawal, the customer must return the product within a maximum of fourteen days, complete, properly protected and in a condition allowing resale.

Direct return costs are borne by the customer unless otherwise agreed or unless the product is non-conforming.

The right of withdrawal does not apply, in particular, to sealed goods that have been unsealed after delivery and cannot be returned for hygiene or health-protection reasons.

Article 9 – Returns and refunds

Before returning any product, the customer must contact customer service at contact@ielcosmetique.fr to obtain the necessary instructions.

Returned products must be complete, unused and, where applicable, in their original presentation. They must be properly packed to prevent damage in transit.

Where the return conditions are met, the refund is made using the same payment method as the original transaction, unless the customer expressly agrees to another method.

Article 10 – Damaged, defective or non-conforming products

The customer is advised to check the condition of the parcel and products immediately upon receipt.

If a product is damaged, defective, missing or non-conforming, the customer should contact customer service as soon as possible and provide any useful photographs.

After review, an appropriate remedy will be offered in accordance with consumer rights, including replacement, bringing the product into conformity, a price reduction or a refund depending on the circumstances.

Article 11 – Product use and liability

Products must be used for their intended purpose and in accordance with the instructions and precautions provided.

Certain products are intended for professional use or require specific knowledge. The customer remains responsible for following all instructions, precautions and possible contraindications.

IEL Cosmetique shall not be liable for damage resulting from abnormal, inappropriate or non-compliant use of a product.

Article 12 – Statutory guarantees

Products benefit from the French statutory guarantee of conformity under Articles L. 217-3 et seq. of the French Consumer Code and the guarantee against hidden defects under Articles 1641 et seq. of the French Civil Code.

In the event of non-conformity, the consumer has the remedies provided by law, including repair or replacement and, where the statutory conditions are met, a price reduction or termination of the contract.

Article 13 – Personal data

Personal data collected is required to manage customer accounts, process orders, payments, deliveries and after-sales service.

Article 15 – Consumer mediation

In the event of a dispute, the customer must first send a written complaint to IEL Cosmetique in an attempt to reach an amicable solution.

If this process is unsuccessful, the consumer may refer the matter free of charge to the consumer mediator appointed by IEL Cosmetique.

Article 16 – Applicable law and disputes

These General Terms and Conditions of Sale are governed by French law, without depriving consumers of any mandatory protections applicable in their country of residence.

The parties will first seek an amicable solution. Failing this, the dispute will be referred to the competent court in accordance with the applicable legal rules.

Article 17 - Extended Producer Responsibility (EPR)

IEL Cosmetique is registered with ADEME under the Extended Producer Responsibility (EPR) scheme for household packaging and graphic paper.
